Violation of the following policies will result in immediate termination of accounts. "Sexually Explicit Adult Content" or "Content Which Advocates The Sexual Exploitation Of Children" or pages linking to such content is not allowed on SunVirtual Inc. Servers. In short, if it is something inappropriate for a six year old to view, it does not belong here! Users may not download or store illegal copies of commercial software. If we find commercial software stored on our system, we will delete the files and immediately terminate your service. Trying to "hack" root or user logins on any machine is forbidden. Attempting to do so will result in immediate account termination. Users may not run packet sniffers or similar programs. IRC programs are not allowed. Users may not have IRC programs running at any time. This includes both "Bots" and IRC sessions.

EMAIL AND USENET (NEWS)
Users may not "Spam" or flood the Usenet with a single post to a large number newsgroups (10 or more) not related to the topic of your article., or make many posts with essentially the same content to many different newsgroups.

Users may not post off topic messages to Usenet. This includes messages violating the specific newsgroup's charter or purpose. 

Users may not make physical threats against another person via e-mail, news or any other electronic media/service provided by SunVirtual Inc.

Users may not forge e-mail or news postings (to include cancel messages, whether manual or automated). 

Users may not "Spam" people via email. This is defined as unsolicited (unwanted, un-requested) email.

WEB PAGES AND SERVER PROCESSES
Users are given the following web resources by default. Please refer to the Server FAQ for additional bandwidth and data storage information. 

A maximum of 200 Mbytes/day or 500 Mbytes/day (depending on your account type) in data transferred. (MB limits are significantly different for commerce hosting, refer to your commerce account manager for more information) 

A maximum of 1,000 cpu-seconds/day in CGI execution time. 

Users may not run there own servers (ftp, IRC, MUDs, MUSHs, etc.) on SunVirtual Inc. machines. 

Users are not allowed to run background jobs while not logged in. 

SunVirtual Inc. reserves the right to kill off CPU intensive processes.

Individual processes MUST consume less then 20 seconds of cpu per hour, may not be disk intensive, and must consume less then 300K of active memory. 

Users may not schedule a cron process to run more often than once every 2 hours. 

ACCOUNT SECURITY
Users must safeguard their account passwords as if they were credit card numbers or social security numbers. If someone were to gain access to your account password, they could tamper with your files and your email. 

Users must comply with requests of SunVirtual Inc..

If we feel your account, programs you run or your password is insecure or you fail to comply with security requests, we will  suspend your account until the matter is resolved. 

PRIVACY
SunVirtual Inc. has a strong commitment to respect and protect the privacy of its customers and their information that is stored on SunVirtual Inc.'s Hosting Services. SunVirtual Inc. will only access and disclose information as necessary to comply with applicable laws and government requests, to provide the SunVirtual Inc. Services, to operate or maintain its systems or to protect itself or its customers. 

NON-SPECIFIC
Users may not mount an attack against our system or any other systems. This includes but is not limited to mail bombing (sending three or more unsolicited pieces of e-mail or files exceeding 500K), "hacking" or attempting to gain root access, ping flooding, tsunami or flood bots or annoyance utilities like "nuke" or "flash". 

Users may not run mailing lists from or through any of our machines or mail servers.

Placing your order confirms your acceptance of these terms. Please press the "back" button on your browser to return to the ordering area when you have finished reading this document. The person or entity ordering this account will hereafter be referred to as "User." Subject to the provisions hereof, the account will be opened upon reception of contract, and repeated in each successive billable period thereafter at the then applicable prevailing rates and charges, unless written notice of cancellation is received from User at least 30 days prior to the beginning of the next billable period. Charges for "billable period rate" services are payable prior to the beginning of each period. Failure to pay in no way relieves the user's obligations to make full payment. User hereby agrees to pay any and all attorney fees, court costs, and related expenses incurred by SunVirtual Inc. in the collection of any amount due it. SunVirtual Inc. may, with 30 days written notice, amend the rates and or charges for any future server usage and/or services. User agrees to use all SunVirtual Inc. services and facilities at User's own risk. SunVirtual Inc. specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall SunVirtual Inc. be liable for any loss, or loss of data, or any other damages. User agrees to protect and indemnify SunVirtual Inc. against any and all liability, loss, or expense arising from claims of libel, unfair competition, unfair trademarks, trade names or patents, violations of rights and privacy and infringement of copyrights and property resulting from User's use of SunVirtual Inc. services. SunVirtual Inc. reserves the right to cancel any account, at any time, without notice, for any reason SunVirtual Inc. considers appropriate. Use of the email system to send unsolicited email or UseNet postings is specifically not allowed from any SunVirtual Inc. account. At SunVirtual Inc.'s discretion, access to SunVirtual Inc.'s Internet Account may be revoked at any time for abusive conduct on the system and/or the Internet and its resources as a whole. User is solely responsible for usage of SunVirtual Inc.'s internet services and any statement User makes on SunVirtual Inc.'s system may be deemed a "publication" of the information entered. Acknowledging the foregoing, User specifically agrees not to use SunVirtual Inc.'s service in any manner that is illegal, libelous, or against any SunVirtual Inc. policy. "Sexually explicit Adult Content" is not allowed on SunVirtual Inc. Servers. The minimum contract length is 3 months. Payments shall be made quarterly as indicated in the purchase agreement information below. SunVirtual Inc. also reserves the right to cancel any services/account without notice for reasons it sees as fit and just.

SunVirtual Inc. warrants to respect a 30-day money back guarantee on refund requests it sees as valid and warranted. The guarantee starts on the date indicated in this agreement. The guarantee does not cover Domain Registration fees. Domain Registration fees are NON-REFUNDABLE. If user elects to purchase an account that includes Domain Registration, the difference between the Normal Registration fees in effect at the time the order is placed and the cost of the hosting will be the only amount refunded. 

The billable service period begins on the date the services indicated in this agreement become available to User. 

This Agreement shall be governed by and interpreted in accordance with the laws of the Sovereign State of Florida, one of the several states of the United States of America, and the courts of the judicial district of county of Collier shall have exclusive jurisdiction in respect of any proceeding in connection with this Agreement.
